Don’t Pay a Penny More Than You Have To – A Guide to Drainage Responsibility
A blocked drain is a nuisance to deal with, but you may feel better knowing that the bill isn’t always your responsibility. So, how do you work out who pays for blocked drains and sewers? Usually it’s the case that you’re responsible for ‘private drains’ within your property boundary. Once those pipes merge with a neighbour’s or leave your property boundary, they become ‘public sewers’ which are managed by the water authority.
At Drainflow, we’ve cleared pipes across Bedfordshire, Buckinghamshire, and Hertfordshire for over twenty years. We’ve seen this ‘who pays?’ confusion over and over again. That’s why we’ve created this guide to help you pinpoint the problem, so you don’t waste money on problems that your water company should fix for free.
The Private vs. Public Rule – Identifying the Boundary
In order to work out who should be paying, you first need to identify which category your pipe falls into. In Beds, Bucks and Herts, drainage responsibility is split into three main areas:
- Private Drains – These are the pipes that serve only your home and are located inside your property boundary. If a blockage happens to any of these pipes – such as a build-up in your kitchen sink waste pipe, or perhaps from tree roots in your garden – it’s your responsibility to clear it.
- Lateral Drains – These are the parts of the pipe that carry waste away from your home but are located outside your property boundary – under the pavement or road.
- Public Sewers – These are the large pipes that collect waste from multiple properties and carry it to a processing plant.
The law changed in 2011, removing responsibility from property owners for lateral drains or public sewers. Across Bedfordshire, Buckinghamshire, and Hertfordshire, these public utilities are managed by the local water authority (such as Anglian Water or Thames Water). If the blockage is in their section, they are legally required to fix it at no cost to you.
At Drainflow, we always check the location of the blockage before we start work on it. If we find the issue is in a lateral drain or a shared sewer pipe, we’ll tell you straight away so you can call the water company and arrange for them to deal with the problem.
Spotting the Blockage Source – 4 Clues That Save You Money
In our decades of clearing drains, we’ve found that a few minutes of detective work can save a homeowner an awful lot of stress. Use this list to check out the clues your drains are creating to work out if the blockage belongs to you or the water company:

- Internal vs. External – If the nasty smell and the backup are just in one room, it’s probably an internal private pipe. If sewage is appearing in your garden or driveway, then it’s the main drain that is blocked.
- Shared Pipes – If you live in a semi-detached or terraced house in Herts, Beds or Bucks, your drains probably merge with your neighbour’s before arriving under the street. Look at your gully or manhole in the garden. If it’s overflowing with sewage, and your neighbour is also seeing a backup, it’s a shared sewer – and that means it’s the water company’s job to fix.
- The Flushing Test – Run several taps at once. If the water stays down, the blockage is minor. If the water level rises rapidly in the toilets or drains, you have a major blockage that needs professional attention.
- Ground Movement – Notice any new sinkholes or unusually green, wet patches of grass? This often signals a collapsed pipe on your property, which is a private repair job.
How to Deal with Your Water Company (And Get Results)
If your checks suggest the blockage is in a public sewer, you need to contact your water provider (Thames Water or Anglian Water). Dealing with them can be slow, so you need to be direct to get prompt attention.
Here are our tips – based on experience!
- State the Facts – Tell them how you’ve arrived at your diagnosis of the problem, and let them know that neighbours are affected, if that’s the case. This way you’re providing evidence right from the start that it’s a lateral or public drain problem right from the start.
- Mention Risk – If sewage is backing up, or visible near the house, tell them immediately. This moves you up their priority list.
- Get a Reference Number – Don’t hang up without a job number. Note down the time you called and who you spoke to.
- The Drainflow Shortcut – If they tell you it will be 24 hours, but you don’t want to wait, call us on 01525 718500. We attend promptly and can confirm the location of the blockage. If we find it’s your water company’s responsibility, we can provide the professional visual evidence you need, using a CCTV drain survey, to push them for action.
